Terms & Conditions
Welcome to Samaya London. These Terms & Conditions apply to consumer purchases made through samayalondon.co.uk. Please read them before placing an order.
Nothing in these terms limits your statutory consumer rights.
1. About us
Samaya London is the trading name of Samaya London Ltd.
- Business address: Flat 3 Cornelia House, 3 Caversham Rd, NW94DU
- Email: info@samayalondon.co.uk
- Telephone: +44 7562591793
- Company registration number and place of registration: 16167402
In these terms, “we”, “us” and “our” refer to the business identified above.
2. Our products
We aim to describe our products accurately, including their fabric composition, measurements and care requirements. Please read the individual product description before ordering.
Where a product is handmade, small variations in texture, finish or measurements may occur. These variations do not affect your right to receive goods that match their description, are of satisfactory quality and are fit for purpose.
Product colours may appear slightly different depending on your screen and display settings. This does not exclude your rights if a product is materially different from its description.
Please follow the care instructions supplied with your purchase. Damage caused by incorrect care, misuse or ordinary wear does not normally constitute a manufacturing fault.
3. Prices and payment
The applicable price, currency and delivery charges are displayed before you complete your purchase. Prices include VAT where applicable.
Payment must be made using one of the payment methods offered at checkout.
If we discover a pricing or product-description error affecting your order, we will contact you before accepting it. You may choose to proceed with the corrected information or cancel for a full refund. We will not charge you a higher amount without your agreement.
4. Placing an order
Please check your order details, delivery address and contact information before submitting your purchase.
An automated order acknowledgement confirms that we have received your order. It does not constitute acceptance. Your order is accepted, and a contract is formed, when we send your dispatch confirmation.
If we cannot accept your order—for example, because an item is unavailable or payment cannot be authorised—we will notify you and refund any payment taken without undue delay.
5. Delivery
Available delivery destinations, charges and estimated times are shown at checkout or on our Delivery page.
Unless we agree a different delivery period with you, we will deliver your goods within 30 days of accepting your order.
If delivery is delayed, please contact us. Your legal rights may include setting a reasonable additional delivery deadline or cancelling immediately where delivery by an agreed date was essential.
Goods remain our responsibility until they are physically received by you or a person you nominate to receive them, unless you independently appoint a carrier that we did not offer.
If you notice an incorrect delivery address, contact us promptly. We will help where possible, although changes may not be possible once an order has been dispatched.
6. International orders
Available international destinations are shown at checkout.
Where import duties, local taxes or customs charges are not included in the checkout total, we will make this clear before you order. Charges payable by you are determined by the destination country.
International delivery estimates may be affected by customs processing. Your applicable statutory rights remain unaffected.
7. Your right to cancel
For most online purchases, you may cancel without giving a reason from the time you place your order until 14 days after the day you receive your goods.
If goods from one order are delivered separately, the cancellation period normally ends 14 days after the day you receive the final item.
To cancel, email info@samayalondon.co.uk, clearly stating that you wish to cancel. Include your name and order number so we can identify your purchase.
You may use the cancellation form at the end of these terms, but you do not have to.
After notifying us, you must send the goods back within 14 days to:
Unit 6N, Atlas Business Center, NW2 7HJ
You are responsible for the direct cost of returning goods when you change your mind. We cover reasonable return costs where goods are faulty, damaged on arrival or incorrectly supplied.
Please package returns securely and retain proof of postage.
You may inspect goods as you would in a shop. We may deduct an amount for any reduction in value caused by handling beyond what is necessary to establish their nature, characteristics and functioning.
Original packaging is helpful but is not a condition of exercising your statutory cancellation rights.
8. Refunds following cancellation
When you cancel an entire order, we will refund the price paid and the cost of our least expensive standard delivery option. Any additional amount paid for an upgraded delivery service is not refundable under the statutory cancellation right.
We will refund you without undue delay and within 14 days after receiving the returned goods or evidence that you have sent them back, whichever is earlier.
Refunds will be made using the original payment method unless you expressly agree otherwise. We will not charge a refund fee.
If you cancel before dispatch, we will refund you within 14 days of receiving your cancellation notice.
9. Personalised and custom products
The statutory change-of-mind cancellation right does not apply to goods made to your specifications or clearly personalised.
Where this exception applies, we will explain it before you place your order. A product is not automatically excluded simply because it is handmade or produced after ordering.
Your rights concerning faulty, damaged or incorrectly described goods still apply.
10. Faulty, damaged or incorrect goods
Your goods must be of satisfactory quality, fit for purpose and as described.
If an item arrives faulty, damaged or incorrect, contact [customer service email] with your order details and a description of the issue. Photographs can help us assess the problem but are not a condition of your statutory rights.
Where goods breach these requirements, you normally have a short-term right to reject them within 30 days of delivery and receive a refund.
After this period, you may be entitled to a repair or replacement and, where the legal conditions are met, a price reduction or refund.
We will cover reasonable return costs for goods that are faulty or incorrectly supplied. Please contact us so we can arrange an appropriate return method.
11. Offers and promotional codes
Any conditions for an offer—including its expiry date, eligible products and minimum spend—will be stated alongside the promotion.
Discount codes cannot be combined unless the offer expressly allows it.
Promotions do not affect your statutory consumer rights.
12. Website content
Website text, photographs, designs and branding belong to Samaya London or are used with permission.
You may view and use the website for personal shopping purposes. Commercial reproduction or distribution of our content requires permission, except where permitted by law.
13. Privacy
We handle personal information in accordance with our Privacy Policy. Please read that policy for information about how we collect, use and protect your data.
Our Cookie Policy explains how cookies and similar technologies are used on the website.
14. Our responsibility to you
If we breach these terms or fail to use reasonable care and skill, we are responsible for loss or damage that is a foreseeable result.
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
These terms are intended for consumer purchases. Please contact us separately about wholesale or business orders.
15. Complaints
If you have a complaint, please email info@samayalondon.co.uk with your order number and details of the issue.
We will investigate and work with you to resolve it. If we cannot resolve your complaint, we will provide information about a relevant alternative dispute resolution provider and state whether we are willing or required to use that process.
16. Applicable law
These terms are governed by the laws of England and Wales.
If you live elsewhere, this does not remove any mandatory consumer protections that apply in your country of residence. You may bring proceedings in the courts available to you under applicable consumer law, including your local courts where permitted.
17. Changes to these terms
We may update these terms from time to time. The version in effect when you place your order will apply to that purchase.
